Motion for Court Hearing
If either party disagrees with the administrative findings and recommendations on the revised amount of child support by the CJFS-OCSS, they may request a court hearing. The party may request a Judicial (Court) review by filing a Motion for Court Hearing with the Domestic relations Court within fifteen (15) days after the issuance of the findings and recommendations. A time-stamped copy of the Motion along with your “request for Court Hearing/Judicial Review” form must be returned to the CJFS-OCSS to allow them to forward it to the Court so that the matter can be set for a hearing.
If neither party files a timely Motion for Court Hearing for the review on the revised amount of child/medical support within fifteen (15) days after issuance of the findings and recommendations, the CJFS-OCSS will submit the revised child/medical support to the court for inclusion in a revised child support order.
Motion for Mistake of Fact Hearing on Notice of Default
A Motion for Mistake of Fact Hearing on Notice of Default has to be filed with the Clerk of Courts within seven (7) days of the default determination being made by CJFS-OCSS. The court shall hold a hearing as soon as possible, but no later than ten (10) days, after the motion is filed. The hearing shall be limited to a determination of whether there is a mistake of fact in the default notice.
